Welcome to FlowBridge ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the FlowBridge order management platform, including our website, APIs, and integrations (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business entity you represent. By using the Service, you represent and warrant that you meet these requirements.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

4. Use of the Service

We grant you a limited, non-exclusive, non-transferable licence to use the Service subject to these Terms. You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorised access to the Service or its related systems
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Use the Service to send unsolicited or unauthorised communications, including spam
  • Resell, sublicence, or redistribute the Service without our prior written consent

5. Third-Party Integrations

The Service integrates with third-party platforms to provide its functionality, including:

  • WhatsApp Business Platform (Meta Platforms, Inc.) — for sending order notifications. Your use of WhatsApp through FlowBridge is subject to the WhatsApp Business Terms of Service.
  • SendGrid (Twilio) — for email delivery of order notifications.
  • Sage — for accounting system integration where configured by you.

You are responsible for complying with the terms and policies of any third-party services you connect to through FlowBridge. We are not responsible for the availability, accuracy, or conduct of third-party services.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by FlowBridge and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any data you upload or input into the Service.

8. Payment and Billing

If your use of the Service requires payment, you agree to pay all applicable fees as described in your service agreement. We reserve the right to modify our pricing with reasonable notice. Failure to pay may result in suspension or termination of your access to the Service.

9. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or other operational reasons. We will endeavour to provide advance notice of any planned downtime where practicable.

10. Limitation of Liability

To the maximum extent permitted by applicable law, FlowBridge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
